Prenuptial Agreements are helpful for many couples as they allow for them to agree, before they marry, how these difficult decisions will be made.

Writing a Prenup

A prenuptial agreement is a formal agreement drawn up before marriage, which sets out who owns what at that time, and how the couple envisage that assets should be divided in the event of divorce or separation. Postnuptial agreements are exactly the same as prenuptial agreements, except for the fact that they are entered into after the marriage/civil partnership, but obviously before divorce or separation.

Neither form of agreement is legally binding. Courts are, however, willing to attach substantial weight to them, and may hold parties to the terms agreed. Whether prenuptial or postnuptial, these agreements must be ‘fair’. What is ‘fair’ varies widely, depending on individual circumstances, therefore legal advice should be sought. These agreements need to be carefully drafted to suit you.
