Nuisance can take many forms, but the law recognises two principle forms of nuisance: private and public.
Private Nuisance Claims
A claim for private nuisance can be brought by you against the creator of the nuisance or the owner/occupier of the land from which the nuisance originates. Common causes of nuisance include:
- Loud music/TV
- Dog barking/animal noise
- Industrial, construction or commercial noise
- Alarms sounding without reason
- ‘Behavioural’ noise – doors banging, DIY/machinery noise, noise from domestic appliances, etc.
Not all of these will automatically give rise to a claim for nuisance. The court will look into the duration of the nuisance, the neighbour’s intent and how the land is normally used.
Public Nuisance Claims
Public nuisance is slightly different. To raise a claim for public nuisance, you must be able to show that the nuisance is affecting more people than just yourself. Common types of public nuisance include obstructions to the road/highway.
