It is good for all involved if disputes can be resolved amicably. Mediation and Alternative Dispute Resolution (ADR) is an effective way of resolving family disputes in this manner.

Alternative Dispute Resolution

ADR is a voluntary process that can be very effective in resolving family disputes, in particular when children are involved.

It can be used to find resolution in a wide range of family law matters; for example, issues relating to children and financial settlements.

When a family dispute arises, there are several alternatives to court that may be used:

•    Litigation,
•    Collaborative family law,
•    Negotiation,
•    Arbitration, or
•    Mediation.

What is Mediation?

Mediation is a form of ADR. It comprises of a series of structured discussions with a trained mediator, who is often a separate lawyer. Solicitors are not present in the mediation sessions, however they generally give steering advice to clients while the mediation is ongoing.

Mediation requires a level of trust and co-operation between the parties; therefore it is not suitable for every case. It can also be a very lengthy process. Where matters are more complicated, litigation may be the best way forward.
